Terms of Use & End User License Agreement (EULA)

PLEASE READ THESE TERMS CAREFULLY. By tapping “I Agree,” creating an account, or otherwise using Almai (the “App,” “Service,” or “Almai”), you (“you,” “your,” or “User”) enter into a binding legal agreement with Almai SpA (“Almai,” “we,” “us,” or “our”). If you do not agree to every part of these Terms, do not tap “I Agree” and do not use the App.

You must affirmatively accept these Terms during onboarding before you can use any social or messaging feature of Almai. Your acceptance is recorded.

This document is a self-contained End User License Agreement and Terms of Use. It is the custom EULA for Almai as permitted under the Apple App Store Review Guidelines. It governs your use instead of (and supersedes) Apple's standard Licensed Application End User License Agreement (the “Apple Standard EULA,” available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), except that, to the extent Apple requires any minimum term from the Apple Standard EULA, those minimum terms are incorporated by reference and apply in addition to these Terms.


0. Summary of the rules that matter most (not a substitute for the full Terms)

  • Zero tolerance. There is zero tolerance for objectionable content and for abusive users. See Section 6.
  • You can report and block. Every message and every user profile has a Report control and a Block control. See Section 7.
  • We act fast. We act on reports of objectionable content within 24 hours by removing the content and ejecting the user who provided it. See Section 7.3.
  • Aura is an AI. Your companion, Aura, is artificial intelligence. It is not a human, not a licensed professional, and does not give professional, medical, legal, financial, or relationship advice. See Section 4.
  • AI processing of your messages. To work, Almai sends your conversation text — and, for safety screening, your messages to other users — to our third-party AI provider (Anthropic). You must consent. See Section 5.
  • 18+. You must be 18 years or older to use Almai. See Section 3.
  • You can delete your account and data in the App, at any time. See Section 9.
  • Matching is algorithmic, not random or anonymous. See Section 1.

1. What Almai is

Almai is an AI-powered social matching application. A conversational AI agent named Aura talks with you to build an understanding of your personality, interests, and values. Almai then uses an algorithmic compatibility process — personality-based profiling and mathematical similarity scoring — to suggest other real, identified Users with whom you may be compatible, and lets you exchange messages with the people you match with.

Almai is not a random-chat, anonymous-chat, or “roulette”-style service. Matches are produced by an algorithm operating on consented personality data, and every person you can message is an identified account holder, not an anonymous or randomly assigned stranger. Almai is not a “hookup” service and may not be used to arrange, solicit, or facilitate prostitution, sexual services for compensation, human trafficking, or any commercial sexual activity.


2. Acceptance, eligibility gate, and changes

2.1 Agreement to Terms

By tapping “I Agree,” creating an account, or using the App, you agree to these Terms, to our Privacy Policy (https://almai.cl/privacy), and to our Community Guidelines incorporated below. If you are accepting on behalf of another person or an organization, you represent that you are authorized to bind them.

2.2 Acceptance is required and gated

You cannot access Almai's conversation, profile, matching, or messaging features until you have accepted these Terms in-app. We record the version of the Terms you accepted and the date of acceptance.

2.3 Changes to the Terms

We may update these Terms. If we make material changes, we will notify you in the App and/or by other reasonable means and, where required, ask you to accept the updated Terms before continuing. Your continued use after an update takes effect means you accept the updated Terms.


3. Eligibility and age requirement

  • You must be at least 18 years old to create an account or use Almai. Almai is intended for adults and is rated accordingly on the App Store.
  • By using Almai you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under the laws of your jurisdiction.
  • You may not use Almai if you are a convicted sex offender.
  • We may use reasonable measures to verify age and will terminate accounts we believe belong to minors. If you believe a minor is using Almai, report it immediately (Section 7 and Section 13).

4. Aura — AI feature disclaimer

Aura is an artificial-intelligence software feature, not a human being and not a professional advisor.

  • Aura is powered by large language models. Its responses are machine-generated and may be inaccurate, incomplete, outdated, or inappropriate. AI can “hallucinate” and state things that are not true.
  • Aura does not provide medical, mental-health, psychological, legal, financial, safety, or professional relationship advice, and nothing Aura says is a substitute for a qualified professional. Do not rely on Aura for any decision that requires professional judgment. If you are in crisis or may harm yourself or others, contact your local emergency services or a qualified professional immediately.
  • Personality insights, compatibility scores, and match suggestions are automated estimates for entertainment and social-discovery purposes only. They are not guarantees of compatibility, character, safety, identity, or suitability of any person.
  • AI-generated content produced by Aura is held to the same standards as user content under these Terms. We design Aura to refuse objectionable, harmful, or unlawful requests. Do not attempt to manipulate, “jailbreak,” or prompt Aura to produce objectionable, harmful, sexual-exploitation, harassing, or unlawful content; doing so violates these Terms (Section 6) and may result in ejection.
  • You are responsible for how you use information you receive from Aura.

5. AI processing of your content and required consent (third-party AI)

To provide the core experience and to keep the Service safe, Almai transmits certain content you create to a third-party artificial-intelligence service provider that processes it on our behalf:

  • Your conversation messages with Aura and personality-insight text derived from those conversations are sent to our AI provider — Anthropic, PBC (“Anthropic”) (model claude-sonnet-4-6) — to generate Aura's replies and to analyze your personality for matching.
  • Your direct messages to other Users (match chat) are sent to Anthropic for one purpose only: automated screening for objectionable content before delivery (Section 8). Match messages are not used to generate Aura's responses and not used to build your personality profile.
  • Personality embeddings used for matching are generated within Almai's own infrastructure and are not sent to any external AI service.

Explicit consent. By accepting these Terms and by choosing to converse with Aura, you give your explicit consent to this sharing of your content with Anthropic for the purposes described above and in our Privacy Policy. Our Privacy Policy and in-app disclosures identify our third-party AI provider. We will obtain your consent before sharing your personal data with our third-party AI provider, and you can withdraw consent by ceasing to use the Aura conversation feature and/or by deleting your account (Section 9). Our Privacy Policy and App Store privacy disclosures reflect this AI data sharing.

If you do not consent to AI processing of your content, do not use the Aura conversation feature.

5.1 Website cookies and analytics (website only)

The above concerns the app. Separately, our public website (not the app) uses Google Analytics for aggregate usage analytics, and it loads only if you accept it in the cookie notice; you can decline or change your choice anytime via “Cookie preferences” in the footer. This website analytics is never included in the app and is described in detail in our Privacy Policy (https://almai.cl/privacy, Section 2.9).


6. Zero-tolerance policy for objectionable content and abusive users

Almai has ZERO TOLERANCE for objectionable content and for abusive users. This is a condition of your license to use the App.

6.1 Definition of objectionable content

“Objectionable content” includes, without limitation, any content or conduct that:

  • is sexually exploitative of, or sexualizes, minors in any way (we report child sexual abuse material to the authorities and to NCMEC where applicable);
  • is pornographic, or solicits or offers sexual services for compensation, prostitution, or trafficking;
  • harasses, bullies, stalks, intimidates, degrades, or threatens any person;
  • contains physical threats, incites or promotes violence, terrorism, or self-harm;
  • is hateful, or attacks or demeans a person or group based on race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, age, or other protected characteristic;
  • objectifies, rates, ranks, or “votes” on real people in a degrading manner (e.g. “hot-or-not”-style content);
  • is defamatory, fraudulent, deceptive, a scam, phishing, or impersonates another person;
  • shares another person's private or identifying information without their consent (“doxxing”), including sexual images shared without consent;
  • is unlawful, infringes intellectual-property or privacy rights, or facilitates any of the above; or
  • is otherwise obscene, abusive, or objectionable as determined by us in our reasonable discretion.

6.2 Our rights — removal and ejection

We may, at any time and without prior notice, remove, hide, or disable any content and suspend, eject, ban, or permanently terminate any User who we determine, in our reasonable discretion, has violated this Section, these Terms, or our Community Guidelines — or to comply with law or protect Users. “Ejecting” a user means terminating their access and removing or disabling their offending content. We may also retain information as required to comply with legal obligations or enforce these Terms.

6.3 No requirement to monitor; right to act

We are not obligated to monitor content but reserve the right to review, moderate, filter, and act on content and accounts, including automated filtering of objectionable material (Section 8).


7. Reporting, blocking, and our response (Apple Guideline 1.2 controls)

We provide the following safety controls in the App. They are available directly on the content and on the user — not buried in settings.

7.1 Report

  • Every message and every user profile has a “Report” control. You can report any message you receive, any User, and any AI-generated content you believe is objectionable.
  • Reporting is quick and in-app. You may add a reason. We acknowledge receipt and review every report.

7.2 Block

  • Every User has a “Block” control, available on their profile and on any conversation with them.
  • When you block a User: you and they can no longer message each other, the match is removed or hidden, and you no longer see their content or profile. Blocking takes effect immediately and does not notify the blocked User.
  • You can manage blocked users in the App.

7.3 Our response — action within 24 hours

We provide timely responses to concerns. Specifically, we act on objectionable-content reports within 24 hours by removing the content and ejecting the user who provided the offending content. Depending on severity we may also permanently ban the user, preserve evidence, and notify law enforcement. We will take appropriate action and may follow up with the reporting User where appropriate.

8. Content filtering and moderation

To keep Almai safe, we use a combination of:

  • Automated AI filtering of objectionable material, applied to user-generated content before it is delivered — including the direct messages Users send to one another, which are classified by our AI provider (Anthropic) and blocked if found to be objectionable;
  • A safety layer applied to Aura's AI output designed to prevent the AI from producing objectionable, harmful, or unlawful content;
  • Human review of reports and flagged content; and
  • Account-level enforcement (warnings, suspensions, ejection, and permanent bans).

No filter is perfect. The presence of these measures does not make us responsible for content created by Users or for any harm arising from interactions between Users (Section 11).


9. Account creation, deletion, and data deletion

9.1 Account creation and sign-in

  • Almai has significant account-based features, so an account is required to use the core experience. We use a third-party authentication provider (Clerk) to create and secure your account, with sign-in by email and a one-time verification code.
  • We will not require you to provide personal information beyond what is relevant to the Service's core functionality or required by law.
  • Almai does not use third-party “social” or single-sign-on login (such as Facebook or Google sign-in). If we add any third-party social sign-in on iOS in the future, we will also offer a privacy-respecting equivalent (such as Sign in with Apple) with comparable prominence, as Apple requires.

9.2 In-app account deletion (you control this)

  • You can delete your Almai account and associated personal data at any time, from within the App. The deletion control is located in the “You”/Settings tab, near “Sign out.”
  • Deleting your account permanently removes your entire account record and the personal data associated with it, including your conversations with Aura, your personality insights and embeddings, your matches, and the messages you sent in match chats, subject only to data we are legally required or permitted to retain (for example, to comply with law, prevent fraud or abuse, resolve disputes, or enforce these Terms).
  • Deletion is not merely deactivation, disabling, or pausing your account.
  • A confirmation and/or re-authentication step may be required to prevent accidental deletion. We will not require you to make a phone call, send an email, or complete a support flow in order to delete your account. If completing deletion requires a web step, the App links you directly to the completion page.
  • If you signed in with Apple, we revoke the associated Apple tokens upon deletion as required.
  • Account deletion is available to all Users in all regions, including any guest or automatically created accounts and their data.

9.3 Other privacy rights

How we collect, use, retain, and delete data — and how you withdraw consent or request deletion — is described in our Privacy Policy (https://almai.cl/privacy), which is also linked inside the App.


10. Acceptable-use rules and your content

10.1 Acceptable use

You agree that you will not, and will not allow anyone else to:

  • post or transmit any objectionable content (Section 6);
  • use Almai to send anonymous, prank, harassing, or unsolicited messages, or to spam or solicit Users commercially;
  • use Almai for “hookups,” prostitution, escort services, sexual services for compensation, or trafficking;
  • harvest, scrape, or collect other Users' data, or attempt to identify, locate, or contact Users off-platform without their consent;
  • impersonate any person or misrepresent your identity, age, or affiliation;
  • create an account if you are under 18, or create accounts for others who are under 18;
  • attempt to manipulate, jailbreak, reverse-engineer, or misuse Aura or the matching system, or interfere with the App's operation, security, or moderation systems;
  • upload malware, attempt unauthorized access, or violate any law or third-party right.

10.2 Your content; license to operate the Service

You retain ownership of the content you create (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and moderate your User Content solely to operate, provide, secure, and improve the Service, including delivering messages to Users you match with and the AI processing described in Section 5. This license ends when your User Content is deleted, except for copies we are legally required or permitted to retain and except for content already shared with other Users that they have stored, and except as needed for backups, safety, and legal compliance.

You represent that you have the rights necessary to your User Content and that it does not violate these Terms or any law.


11. Interactions between Users; assumption of risk

Almai is a venue for meeting people. You are solely responsible for your interactions with other Users. We do not conduct criminal background checks or identity verification on Users and do not guarantee the conduct, identity, age, or suitability of any User. Personality insights and compatibility scores are automated estimates and not assurances of any kind.

Use caution and good judgment. Never share sensitive personal or financial information, meet in private for a first meeting, tell someone you trust where you are going, and stop communicating with anyone who makes you uncomfortable — and report and block them (Section 7). To the maximum extent permitted by law, you assume the risks of interacting with other Users and of meeting anyone in person.


12. License grant and restrictions

Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on an Apple-branded device that you own or control, as permitted by the App Store Usage Rules, solely for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App except as permitted by law. All rights not expressly granted are reserved by us and our licensors.


13. Suspension and termination

  • By you: you may stop using Almai and delete your account at any time (Section 9).
  • By us: we may suspend, eject, ban, or terminate your account and license, in whole or in part, with or without notice, if you violate these Terms (including the zero-tolerance policy in Section 6), if required by law, or to protect Users or the Service.
  • On termination, your right to use the App ends immediately and we may delete or disable your account and content. Sections that by their nature should survive (including Sections 4, 5, 6, 10.2, 11, 14, 15, 16, and 17) survive termination.

14. Disclaimers of warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP, AURA, AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free; that AI output, personality insights, or matches will be accurate, reliable, or suitable; or that any User is who they claim to be. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.


15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ALMAI OR ITS OWNERS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE APP, AURA, AI OUTPUT, PERSONALITY MATCHING, OR YOUR INTERACTIONS WITH OTHER USERS, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.


16. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Almai and its owners, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the App, your interactions with other Users, or your violation of these Terms or any law or third-party right.


17. Governing law and disputes

These Terms are governed by the laws of Chile, without regard to conflict-of-laws rules. The exclusive venue for disputes is the courts of Santiago, Chile, except where applicable consumer-protection law gives you the right to bring proceedings in your place of residence.


18. Apple-specific terms

This Section applies because you obtained the App through the Apple App Store. You and Apple acknowledge that:

  • These Terms are between you and Almai only, not with Apple. Almai, not Apple, is solely responsible for the App and its content.
  • Apple has no obligation to provide maintenance or support for the App. Direct all support and claims to Almai using the contact information in Section 7.4.
  • To the extent any warranty is not effectively disclaimed, Apple may refund the purchase price (if any), and Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product-liability, legal/regulatory, and intellectual-property claims; such claims are governed by these Terms and the law.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties.
  • Your use of the App must also comply with the App Store Usage Rules in Apple's media services terms.

To the extent of any conflict between these Terms and any Apple minimum terms required for licensed applications, the Apple minimum terms control only as required by Apple, and the remainder of these Terms continues to apply.


19. Miscellaneous

  • Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and Almai regarding the App and supersede prior agreements.
  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices. We may provide notices in the App or by email to the address associated with your account.
